Just before this decision, everyone on the left was cheering the California v. Texas decision supposedly "upholding" Obamacare on the same grounds - Article III Standing. As I pointed out (see below), we should not be cheering.

While the right has been pursuing a well-thought-out strategy to return us to the Nineteenth Century Lochner era, the left has done nothing but react and fall into the traps they set. It is time for us to wake up and once again take the initiative in developing a long-term strategy in the law.
